Vape Labels and Why are Vaping products categorized as a Tobacco product? Have you seen them? The label statement reads: “WARNING: This product contains nicotine. ... The regulations cover e-cigarettes and electronic nicotine delivery products, for example, promoting specific brands of products and e-liquids. An advertisement for a vaping store would not be required to include the warning label. The labels that you read on products of the vape industry are a little overwhelming or at least that’s what we believe? The overkill of explaining to people that what they are vaping nicotine maybe extremely uncalled for these days. The FDA or US Food and Drug Administration has decided to make sure that they do something extreme to try and protect the public. The new deeming rule amends that the family smoking prevention and tobacco control act, extend the FDAs authority to deem other tobacco products subject to its regulations too. “This rule requires that advertisements, including billboards, for all tobacco products include an addictive ness warning statement. The label statement reads: WARNING: This product contains nicotine. Nicotine is an addictive chemical.” This statement found in the FDA published new requirements. Lucky that they decided that a vape store would not be required to include the advertisement of the warning label. Well it would not be hard to leave that out, but we are thankful that they did here on the retail level. “Could you imagine having a huge WARNING sign on your store name, that would just be terrible for business,” stated Sandy Chin a Store owner here in the USA. “It’s been a real hard task to keep up with all the new Rules and Regulations that seem to appear and change overnight, but at least they are getting better with the time frame of things,” she stated. The FDA published these new warnings for labels and advertisements on packaging. · Appear in the upper portion of the advertisement Occupy at least 20 percent of the area of the advertisement · Be printed in at least 12-point font size and ensure that the required warning statement occupies the greatest possible proportion of the warning area set aside for the required warning statement · Be printed in conspicuous and legible Helvetica bold or Arial bold type or other similar sans serif fonts and in black text on a white background or white text on a black background in a manner that contrasts by typography, layout, or color, with all other material on the advertisement · Be capitalized and punctuated, as described in the regulations · Be centered in the warning area in which the text is required to be printed and positioned such that the text of the required warning statement and the other textual information in the advertisement have the same orientation. · Be surrounded by a rectangular border that is the same color as the text of the required warning statement and that is not less than 3 millimeters (mm) or more than 4 mm. |

So, in the past few years' companies from the E-Liquid and hardware have gone under the fire of labeling to be childlike and illustrate to much of a food product. This means that these labels look child friendly and cause people to believe they were for kids. As adults it is sad that we can’t enjoy labels with color and illustrate what they might taste like but at the same time we understand why these differences must be made. There is a lot of thought that vaping is nothing like tobacco products other than the content of one chemical, nicotine, but if you take the nicotine out of the product does it in fact still constitute as a tobacco product. It’s unclear why law makers see them still as the same product and feel that it’s a laziness in the government to see the difference between them. Vaping should be classified as vaping products instead of tobacco products. That is the politically correct way to correctly classify these products, in a category of their own. This would mean that the FDA and Governments would have to write a whole new set of Rules and Regulations which would mean more money and effort than they are willing to spend. Instead they have decided to run the products together in a same category of products. This leads to the question of “HOW CAN THEY DO THAT,” which is what all of us vapors and USA residents think. It leaves us scratching our heads as we allow our government to get away with the laziness and ridicule of smashing two different sets of products into one. We believe that warning and clear communication is correct and that there should be these on products. But at the same time there should also be a new set of Laws, Rules, and Regulations for the vaping industry. |
